Terms of Service

These Terms of Service ("Terms") govern your access to and use of AI Head Office (the "Service"), operated by E-Commerce Growth Solutions ("we", "our", "us"). By signing up for or using the Service you agree to these Terms.

1. The Service

AI Head Office is a SaaS analytics and AI-assistant platform for e-commerce brands. It connects to platforms you authorize (Shopify, Meta Ads, Google Ads, Klaviyo, Xero, and others) and synthesizes the resulting data into dashboards, daily reports, and AI-generated insights.

2. Eligibility & accounts

  • You must be at least 18 years old and able to enter into a binding contract.
  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity in your workspace, including actions taken by other people you invite to it.

3. Acceptable use

You agree not to:

  • Reverse-engineer or attempt to extract the source code of the Service
  • Use the Service to violate any law or third-party right
  • Connect platforms or accounts you are not authorized to access
  • Attempt to disrupt or interfere with the Service's infrastructure
  • Use the Service to send unsolicited messages or spam

4. Third-party platforms

The Service integrates with third-party platforms via their official APIs. Your use of those platforms remains governed by their own terms. We are not responsible for changes in their APIs, outages, or policy changes that affect availability of features in AI Head Office.

5. Data ownership

You retain ownership of the data you bring into the Service. We hold a limited license to process that data solely for the purpose of providing the Service to you. See our Privacy Policy for details.

6. AI features

AI features (daily reports, Ask AI, anomaly detection) are produced by large language models, including Anthropic's Claude. AI outputs are informational only and may contain inaccuracies. You are responsible for reviewing them before acting. We do not warrant that AI outputs are correct, complete, or fit for any particular purpose.

7. Fees

The Service is currently offered free of charge. We reserve the right to introduce paid tiers in the future and will give you at least 30 days' notice before any change that affects you.

8. Termination

You may stop using the Service and delete your workspace at any time. We may suspend or terminate access if you breach these Terms, with notice where reasonably practicable. On termination, we will delete your data per the retention schedule in the Privacy Policy.

9. Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD 100. We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your use of the Service in violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of New Zealand. Disputes will be heard in the courts of New Zealand, without prejudice to your statutory consumer rights under the law of the country where you reside.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to workspace owners by email and will take effect 30 days after notice. Continued use of the Service after the change constitutes acceptance.
